POOL BRIDGE FARM TERMS AND CONDITIONS
1. DEFINITIONS AND INTERPRETATION
1.1 The following definitions apply:
1.1.1 Lakeside ticket: a person who accesses the grounds around the Lakes but does not enter the Lakes.
1.1.2 Child means any person under the age of 18 years who is accompanying the Customer to the Lakes.
1.1.3 Company or us means Pool Bridge Farm Ltd, incorporated and registered in England and Wales with company number 08061832, whose registered office is at Pool Bridge Farm, Wheldrake Lane, Crockey Hill, York, YO19 4SQ or any other member of its group from time to time, together with the company’s employees who may perform the obligations under these Terms and Conditions.
1.1.4 Customer or you means a person who accepts and agrees to these Terms and Conditions by reading these Terms and Conditions displayed on the webpage https://www.poolbridge.co.uk/swimming-rules and then clicks on the box to confirm they agree and wish to purchase a ticket. If you are using a ticket to enter the venue, you are a customer.
1.1.5 Fee means the fee set out on the Website as amended from time to time.
1.1.6 Lakes mean all lakes or pools used for swimming or aqua sports at Pool Bridge Farm, YO19 4SQ.
1.1.7 Order means the Customer’s order to purchase an entry ticket to the Lakes through the Website.
1.1.8 Temperature means the temperature of the Lakes as recorded daily by the Company and displayed on the digital thermometers onsite.
1.1.9 Website means the Company’s website www.poolbridge.co.uk
1.2 Unless the context otherwise requires, each reference in these Terms and Conditions is a reference to these Terms and Conditions as amended or supplemented from time to time.
2. BACKGROUND
2.1 The Lakes are managed by the Company. The Customer wishes to enter the Lakes in order to participate in water swimming or aqua sports. The purpose of these Terms and Conditions is to set out the terms on which the Company offers the Customer and any Child access to the Lakes for the purpose of open water swimming and aqua sports.
2.2 Any person accessing the Lakes for any reason must have a ticket and, by doing so, has agreed with these Terms and Conditions on behalf of themself, anyone in their group and any Child before accessing the Lakes and has completed a waiver on behalf of themself and any Child before accessing the Lakes.
2.3 All Customers should ensure they, their group and any child fully understand the dangers associated with open water swimming and aqua sports, including the potential for personal injury and property loss. 2.4 Customers are reminded that open water swimming and aqua sports in the Lakes are potentially hazardous and that use of the Lakes is at the Customer’s own risk. All attendees, including those purchasing a Lake or Lakeside ticket, must observe these Terms and Conditions and the Rules and guidelines outlined on our website https://www.poolbridge.co.uk/swimming-rules at all times.
2.5 Whilst the Company makes all reasonable efforts to ensure that the descriptions of the Lakes are correct and reasonably accurate, images and video footage of the Lakes are for illustrative purposes only. By proceeding with an Order, the Customer confirms that they are not relying on any representations made by the Company.
3. BOOKING
3.1 By purchasing a ticket, the Customer:
3.1.1 agrees and accepts to be bound by these Terms and Conditions and confirms that each member of their group and child is able to satisfy the Entry Conditions; and
3.1.2 represents to the Company that the Customer has authority to make the Order on behalf of itself, all group members and any Child and that the Order is subject to these Terms and Conditions.
3.2 No part of the Website constitutes a contractual offer capable of acceptance. The Order constitutes a contractual offer that the Company may, at its sole discretion, accept. The Company’s acknowledgement of receipt of the Order does not mean that it has accepted it. The Company’s acceptance is indicated by sending the Customer a booking confirmation by email. Only once the Company has sent the Customer a booking confirmation will there be a legally binding contract between the parties.
3.3 No person will be admitted without their own ticket and a completed waiver which states they have read and accepted these Terms and Conditions.
3.4 The Company may, at its absolute discretion, decline an Order.
3.5 Upon the Company accepting an Order, payment of the associated Fee must be made by the Customer.
3.6 All pre-booked tickets are non-refundable except as required by law. This includes the statutory right to cancel within 14 days unless the booking is for a specific dated event, in which case the cancellation rights do not apply under regulation 28(1)(h) of the Consumer Contracts Regulations 2013
3.6.1 If a Customer is unable to attend, no refund or transfer will be offered unless the Company chooses to do so at its discretion or there are more than 5 days before the commencement of the booking. If the booking is more than 5 days away, the customer may reschedule their booking to another date using their online account. If it is within 5 days, bookings can not be changed. Customers are encouraged to ensure they are available before booking.
3.7 The Customer agrees to be legally responsible for any Child and confirms that the Child understands these Terms and Conditions and the Customer therefore accepts these Terms and Conditions on behalf of themselves and the Child.
4. CLOSURE OR CHANGES TO THE LAKES
4.1 The Company reserves the right to close the whole or any part of the lakes or suspend the operation of open water swimming or aqua sports at any time for any technical or operational reasons, weather, capacity, special events, or to ensure the safety and security of customers or if the Company reasonably considers that the circumstances so require. If the Lakes are closed for any of the reasons set out above, the Company reserves the right to offer substitute tickets for admission to the Lakes on an alternative date in substitution for any other form of redress.
5. ENTRY CONDITIONS:
5.1 All persons may access the Lakes subject to the following entry conditions (Entry Conditions):
5.1.1 All persons must have a valid entry ticket and have agreed to and accepted these Terms and Conditions. All entry tickets purchased are only valid on the date and time printed on the ticket.
5.1.2 A person should not participate in open water swimming or aqua sports if they have a known medical condition that would render such participation potentially unsafe for them. If the person has any medical conditions, they should consult with their own doctor to ascertain if they can take part.
.5.1.3 All persons accept that they have a duty to take reasonable steps to ensure their own safety. All persons in and around the Lakes should behave in a safe manner at all times, and must not act in any manner which may disturb other users of the Lakes.
5.1.4 All persons must comply with any reasonable instructions given to them by the Company’s personnel or any third party instructed on behalf of the Company. If a Customer disregards such instructions, then the Company reserves the right to remove them from the Lakes, without any right to a refund.
5.1.5 A person must not enter the Lakes if they are under the influence of drugs or alcohol.
5.1.6 All persons must enter and exit the Lakes at the specified place.
5.1.7 No person is permitted to dive into the Lakes from the bank side.
5.1.8 All persons must be confident in the water and able to swim 50m unaided or in a life jacket when under close supervision of an appropriate adult.
5.1.9 Inexperienced cold water swimmers should only remain in the Lakes for a short period of time; in winter, this may not be more than one minute. Listen to your own body and get out sooner if needs be.
5.1.10 Any person who is an inexperienced cold water swimmer must not swim alone and should do their own research into safe practices before entering the lakes. It is not advised that anyone swim alone. Those who choose to do so accept the increased risks and should take appropriate safety precautions.
.5.1.11 Children up to and including the age of 17 years must be accompanied in the Lakes by a competent swimmer in the water, over the age of 18 (Adult) at all times. There must be a Maximum adult: child ratio of 1:3. Non-swimmers must have a ratio of one child to one adult in the water. Swimmers under the age of 11 must be accompanied by an adult in the water. The adult must stay within 3 metres of an under-11 at all times. Children under the age of 16 are not permitted in the sauna. 16/17 year olds must be accompanied by a parent or guardian in the sauna.
5.1.11.1 A suitable adult is a parent, legal guardian or someone with a generational age gap.
5.1.12 Customers aged 11 to 18 should be accompanied in the Lakes by an Adult, or otherwise be within direct sight of an Adult at the edge of the Lakes at all times. With a Maximum of 3:1 child: adult ratio.
5.1.13 A person below the age of 18 years will only be able to use the Lakes with parental consent and is not permitted to enter the Lakes between 1 November and 31 March inclusive or when the water is below 12 degrees.
5.1.14 A person must not cause any damage or disturbance to the wildlife or flora and fauna surrounding or in the Lakes.
5.1.15 All persons may only use eco-safe sun cream whilst in or around the Lakes.
5.1.16 All persons accept that no dogs are allowed at Pool Bridge Farm, except assistance dogs. This includes the carpark.
5.1.17 Access to any other Lake used for different purposes, such as fishing, is not permitted.
5.2 The Company will show the Temperature at the entrance, and it is the responsibility of the Customer to check the Temperature before entering the Lakes.
5.3 The Customer understands and accepts that the water quality is tested regularly by the Company but may change due to weather conditions or other factors.
5.4 The Customers understand and accept that there are no lifeguards at the Lakes, but that life buoys, throw ropes and air horns are around the Lakes and there are exit points at frequent intervals on the edge of the Lakes.
5.5 If a Customer does not comply with these Terms and Conditions or they fail to agree to these Terms and Conditions, they will not be permitted access to the Lakes or may be removed from the Lakes, without any right to a refund, except where removal was made in error or without cause.
PHOTOGRAPHY
5.6 The Customer grants the Company permission to use any photograph of you at the Lakes (Photograph) for the purpose of marketing the activities we offer at the Lakes (Permitted Purpose).
5.7 Customers agree that no photography of other customers without prior consent should be taken. Anyone in breach of this condition will be asked to leave the premises immediately.
5.7.1 Customers agree that no photoshoots can take place at the premises without prior approval of the management, and there are no drones or long lenses are allowed on site. Compact cameras and phone cameras may be used for personal use only.
5.8 You agree to the Company storing copies of the Photograph for as long as necessary to fulfil the permitted purpose and storing your contact details on our database in case we need to contact you.
5.9 You can withdraw your consent given in clause 7 of these Terms and Conditions at any time by contacting us via the Website. This will not affect the lawfulness of any processing carried out before you withdraw your consent.
5.10 For data protection purposes, we are the controller of (and responsible for) the personal data comprising the photograph and your contact details.
5.11. We will ensure that we comply with the requirements of all legislation and regulatory requirements in force from time to time relating to the use of the Photograph and your contact details.
5.11.2 We will process the Photograph and your contact details in accordance with the Privacy Policy.

6. COMPLAINTS
6.1 The Company always welcomes feedback from its customers, and whilst it always uses all reasonable endeavours to ensure that a customer’s experience is a positive one, the Company nevertheless wants to hear from any customer if they have any cause for complaint. 7 GENERAL
7.1 The Company reserves the right to vary these Terms and Conditions at any time without prior notice as required by law or necessity.
7.2 If any provision or part-provision of these Terms and Conditions is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable.
7.3 These terms are governed by English law, and wherever you live, you can bring claims against the Company in the English courts. If you live in Wales, Scotland or Northern Ireland, you can also bring claims against the company in the courts of the country you live in. The Company can claim against you in the courts of the country you live in.
8. Receipt of Terms
8.1 The customers are deemed to have accepted the T&Cs by completing a purchase and entering the premises.
